CONTENT RIGHTS PROTECTION PROCEDURE

1. General Provisions
1.1. This Procedure sets out how requests from persons who believe that content placed on the Website infringes their intellectual property or other rights are handled.
1.2. The Operator does not conduct prior review of content placed by Users and acts as a provider of intermediary information services within the meaning of the Law of Ukraine "On Electronic Commerce" dated 03.09.2015 No. 675-VIII.
1.3. The Operator does not resolve disputes over title and does not determine who holds the rights to a disputed object. Such disputes are resolved in court.
2. Who May File a Request
2.1. A request may be filed by the rights holder or a person authorized by them, provided a document confirming their authority is submitted.
3. Contents of the Request
3.1. A request must be submitted in writing or to the e-mail address hello@belement.net and must include:
3.1.1. information about the claimant: name or full name, address, and contact details;
3.1.2. identification of the right in question and the basis on which the claimant's rights arose — a certificate, agreement, or other document;
3.1.3. the exact addresses of the Website pages on which the disputed content is located;
3.1.4. a description of the infringement;
3.1.5. a statement that the information provided in the request is accurate and that the claimant is aware of liability for providing false information;
3.1.6. the signature of the claimant or authorized person.
3.2. A request that does not meet the requirements of clause 3.1 may be left unreviewed, with the claimant notified of the reasons.
4. Review Timeframes and Procedure
4.1. The Operator confirms receipt of a request within 2 business days.
4.2. The review period is up to 10 business days from the date of receipt.
4.3. Where there are reasonable grounds to suspect an infringement, the Operator suspends access to the disputed content pending clarification of the circumstances.
4.4. The Operator notifies the User who placed the disputed content of the request within one business day of suspending access and provides them with a copy of the request, excluding the claimant's personal data.
5. User's Objection
5.1. The User has the right to submit a reasoned objection to the Operator within 5 business days, together with documents confirming their rights to the content.
5.2. If the submitted documents confirm the lawfulness of the placement, the Operator restores access to the content and notifies the claimant accordingly.
5.3. If no objection is submitted, or the submitted documents do not refute the request, the content is removed.
6. Repeated Infringements
6.1. In the event of three or more confirmed infringements of third-party rights within 12 months, the Operator has the right to suspend the User's access to their personal account and terminate the agreement unilaterally.
7. Claimant's Liability
7.1. The claimant is responsible for the accuracy of the information provided in the request.
7.2. If a knowingly false request is submitted and causes losses to the Operator or a User, the claimant shall compensate such losses in full.
8. Compliance with Decisions of Government Authorities
8.1. The Operator removes or blocks access to content in order to comply with mandatory court decisions or decisions of other authorized government bodies, without additional review under this Procedure.
