1. General Provisions

1.1. The data controller is Individual Entrepreneur Bobrov Vladyslav Andriiovych, Taxpayer Registration Number (RNOKPP) 3257103796, address: 13 Yaskrava St., Apt. 208, Dnipro, Ukraine (hereinafter — the "Controller").

1.2. This Policy sets out the procedure for processing the personal data of visitors, buyers and sellers of the website www.belement.net in accordance with the Law of Ukraine "On Personal Data Protection" dated 01.06.2010 No. 2297-VI.

1.3. Use of the Website constitutes acknowledgment of this Policy.

2. What Data Is Processed

2.1. Buyers: last name, first name, patronymic, phone number, e-mail address, delivery address and carrier branch, order and payment information, order history, and individual terms set for the account, stored in the personal account.

2.2. Counterparties — Product Suppliers: last name, first name, patronymic or company name, EDRPOU code or taxpayer registration number, address, banking and contact details, tax regime information.

2.3. Visitors: network address, device and browser type, page-view data, cookies.

2.4. The Controller does not collect data on racial or ethnic origin, political, religious or philosophical beliefs, membership in associations, health status, or other data classified as particularly sensitive under Article 7 of Law No. 2297-VI.

3. Purpose and Legal Basis of Processing

3.1. Data is processed for the purposes of placing and fulfilling orders, delivery, accounting and settlements, tax accounting, communication, handling claims, performing agreements with counterparties, and fulfilling obligations imposed on the Controller by law.

3.2. The legal bases for processing are the conclusion and performance of a transaction to which the data subject is a party, the need to fulfil a legal obligation of the Controller, and the consent of the data subject, in accordance with Article 11 of Law No. 2297-VI.

3.3. Promotional and informational mailings are sent only with separate consent, which may be withdrawn at any time.

4. Cookies

4.1. The Website uses cookies to support the shopping cart, save settings, and collect anonymized visit statistics.

4.2. The User may disable cookies in their browser settings. This may limit the functionality of the Website.

5. Disclosure of Data to Third Parties

5.1. Data may be disclosed to carriers for delivery purposes, to payment system operators for processing payments, to marketplaces on which the goods are listed, to product suppliers, to persons providing accounting and legal services to the Controller, and to government authorities in cases provided for by law.

5.2. Disclosure is made to the extent necessary to achieve the relevant purpose.

5.3. The Controller does not sell personal data to third parties.

6. Retention Periods

6.1. Data is retained for the period necessary to achieve the purpose of processing, and, with respect to accounting and tax records, for the periods established by law.

6.2. Upon expiration of the relevant periods, data is deleted or anonymized.

7. Rights of the Data Subject

7.1. In accordance with Article 8 of Law No. 2297-VI, the data subject has the right to: know the sources of collection and location of their data, the purpose of its processing, and the controller; receive information on the conditions for granting access to the data; access their own data; receive a response as to whether their data is being processed; submit a reasoned request for the correction or destruction of their data; protection against unlawful processing; lodge complaints with the Ukrainian Parliament Commissioner for Human Rights or with a court; and withdraw consent to processing.

7.2. Requests are submitted to hello@belement.net and are reviewed within 30 calendar days.

8. Data Protection

8.1. The Controller takes organizational and technical measures to protect data against unauthorized access, alteration, disclosure and destruction.

8.2. Only persons who require access to perform their job duties, and who are obligated not to disclose such data, have access to it.

9. Cross-Border Transfer

9.1. Personal data is transferred to foreign entities only in the cases and manner provided for by Article 29 of Law No. 2297-VI.

9.2. Where the data of individuals located in the European Union is processed, additional requirements set out in a separate document apply.

10. Changes to the Policy

10.1. The Controller has the right to amend this Policy by publishing a new version on the Website. The version published on the Website is the one in effect.
